PERAN PEKERJA SOSIAL PROFESIONAL DALAM PENANGANAN ABH DI LPKS

Abstract

The child has a strategic role for the survival of mankind, the nation and the State. In the
Constitution are listed, that the State guarantees the right of every child (i.c. including ABH)
on survival, grow and develop as well as protection from violence and discrimination. The
main principles of the protection of Children, must be in accordance with the Convention on
the rights of the child (Convention on the Rights of the Child) as it has been ratified by the
Government of the Republic of Indonesia by Presidential Decree Number 36-year 1990. ACT
number 3 of the year 1997 concerning juvenile court, intended to protect the child in order to
face the future and give the opportunity to the children to acquire self-reliance, independent,
responsible after undergoing criminal period. But in practice, the child is positioned as an
object, the wrong treatment that is often detrimental to the rights of the child. In addition,
in the settlement of the problem through a process of ABH is only done in the Court of
law enforcement agencies (litigation). With the enactment of LAW number 11 Year 2012
of SPPA (as a replacement Act number 3 of the year 1997), then fundamentally brought
significant changes in the process of handling the issue of ABH. These changes, among
others, provide a space for civic engagement/non formal figures and related agencies (other
than law enforcement agencies) in the process of problem solving ABH. In substansu the
ACT also required the SPPA to law enforcement agencies (Police, Judges, and Kejaksanaan)
to complete the criminal children outside of the judicial process (versioned) and justicebased
approach deliberations (Restorative Justice), as stated in section 7 of the ACT SPPA.
In the process of diversion, the parties that should be involved, namely: 1) the child and
the parent/guardian, 2) victims and/or parent/guardian, 3) Supervisor’s community, and 4)
Professional social worker).
